Spouse of a U.S. Citizen Visa

If you’re married to a U.S. citizen, there are several visa options available to help you live together in the United States. These include the IR1, CR1, and K-3 visas—each with different requirements based on your marriage timeline and processing needs.

IR1 Visa – Immediate Relative

The IR1 visa is for spouses who have been married for two years or more. It grants permanent residency (a green card) with no conditions, allowing you to live and work in the U.S. without the need for future renewal based on your marriage.

CR1 Visa – Conditional Resident

The CR1 visa is for spouses married less than two years at the time of approval. It grants conditional residency for two years. Before the green card expires, both spouses must file a joint petition to remove the conditions and prove the marriage is ongoing.

K-3 Visa – Temporary Entry

The K-3 visa allows a spouse to enter the U.S. while waiting for an immigrant visa petition to be processed. Once in the U.S., the spouse can apply to adjust status to permanent resident. In many cases, this visa may not be necessary due to faster IR1/CR1 processing times.

The Application Process

  1. Petition Filing: The U.S. citizen files Form I-130 to begin the process.
  2. National Visa Center (NVC): Once approved, the case is sent to the NVC for further processing.
  3. Affidavit of Support: The U.S. citizen must show they meet income requirements to support their spouse. A joint sponsor may be used if needed.
  4. Interview: The foreign spouse attends a visa interview at a U.S. embassy or consulate.
  5. Entry & Residency: If approved, the spouse receives a visa to enter the U.S. and becomes a conditional or permanent resident, depending on the visa type.

Important Reminders

  • Conditional Residents (CR1/K-3) must file to remove conditions within two years of entry.
  • Failure to remove conditions may result in loss of permanent residency.
  • The K-3 is less commonly used today but may benefit couples facing extended delays.
